TERMS & CONDITIONS
Engagement of Supplier:
These terms of trade apply to all sales of Trees, orders & contracts, and cannot be varied or replaced by any other terms.
Acceptance of these terms and conditions will be deemed to be accepted irrespective of whether the customer has acknowledged or signed these terms of trade, by simply:
1. Requesting or accepting a quote
2. Placing an order
3. Accepting delivery of stock
Availability/ Pricing of Stock:
Availability of stock is subject to season and demand.
Pricing is subject to change without notice.
Stratford Trees also offers a Sourcing Service. Due to the large range of plant varieties, and not being able to stock all varieties, we do offer a service to source these requirements. We can source different size plants (Tube stock, or larger size trees), hedging plants, native plants, aqua plants & edging plants.
All quotes are valid for 48 hours from the date of quote unless otherwise specified
A delivery charge will be included if required.
The supplier reserves the right to amend any quote prior to confirmation of a quote to take into account any variables that may result in pricing changes of stock. The supplier will advise the customer of any such changes in writing.
All payment terms are per COD (Cash on Delivery) unless otherwise agreed in writing to approved customers.
A 20% deposit is required on confirmation of all orders.
A holding fee of 3% per month of the total value of purchase excluding GST will apply for plants not collected within one month of purchase.
Delivery can be arranged. Fees from the Growing site are:
Within 75km radius site - Flat fee of $77 incl GST
Over 75km - Flat fee of $77 plus $3.30 per km incl GST
When outside transport is used Stratford Trees holds no responsibility once stock has left the Nursery site.
Retention of Title:
All stock will remain the property of Stratford Trees until full payment has been received.
Stratford Trees has the right to access any property to reclaim any stock (planted or not) that has not been paid for by due date.
Stratford Trees warrants that our trees are true to type and in a healthy condition when sold. Where reasonable proof shows this not to be the case, then Stratford Trees will either replace the tree or refund the purchase price to the customer.
Stratford Trees accepts no responsibility for damages beyond the value of the tree/s. Due to there being many factors beyond their control, such as proper handling, soil preparation, drainage, planting, watering, mulching, insect damage and weather, no guarantee can be given or implied as to plant growth.
Any complaints must be made in writing with in 7 days of receiving the goods.
Stratford Trees will accept returns within seven days of purchase/dispatch as long as the trees are in the same condition/health as when sold.
Returns will not be applicable to stock that has been bought in or grown specifically to order, stock that has already been planted or removed from the original pot/bag.
All delivery/freight charges are non-refundable and will be at the cost of the customer to cover return freight.
